California Steps Towards Gay Marriage

California courts recently determined that Proposition 8, which outlawed gay marriage, is unconstitutional.

Why did the judges decide it was unconstitutional? What amendment did they decide it violates? What right are you guaranteed in that particular amendment? What is your opinion on the issue??

i think love has no gender and it should not matter who we marry and for the government picking a chooseing rights is not ok. sometimes us as Americans we sometimes pick and choose our rights and which rights apply to us and to single gays out is not right at all it is a natural born right to marry who ever, where ever we should all was have our right no matter what gender.

They said it violated Amendment 14 and that denying homosxuals their civil marriage right was unconstitutional.In the 14 amendment it says All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
i feel that its okay for them to get married, stopping them isnt going to make them less gay.

The court said that the ban violated the 14th amendment. The 14th Amendment guarantees that no state can can take away any citizens rights that the United States gives them. I don't believe in gay marriage, however I don't think that it's the governments place to tell people who they can and cannot marry because if you are going to make those promises in the Constitution you have to follow it in all ways.

i agree with Cody on the 14th amendment and how it says " no state can take away any citizen that the US gives them " and if thats the case then if it's not against the law to marry the same sex then you should just let it be . i mean your not the one that's gonna be with them the rest of your life so why does it matter to you what they do ? but my opinion is that you should be able to do as you please , its your life . and besides you not letting them get married , won't keep them for being gay and staying with there significant other .

It singles out gays and lesbians for discrimination. Violating of the 14th Amendment. My opinion on this issue is going to get some people mad but i don't care. Same sex marriage is the nastiest thing of ALL TIME. They need help. One, that is a sin. Two, dating the same sex is unmoral. I really hope that this country don't let same sex marriage be legal. They decided it was unconstitutional because, it intends to to discriminate against gay and lesbians. It violates amendment 14. That your allowed to marry any one you want to. I believe that it is unconstitutional, because gays and are humans just as heterosexual people so they should be treated the same and not differently.

I Believe that its up to you. Because no one can tell you the gender you like so if you like your own gender then thats you no one can change yourself but you. They Violated the 14th Amendment. It allows you to depriving any person of his life, liberty, or property without due process of law, or denying to any person within their jurisdiction the equal protection of the laws.

the judges decided that it was unconstitutional because "the ban unconstitutionally singles out gays and lesbians for discrimination." they decided that it violated amendment 14 and the right that you are guaranteed in this amendment is that " nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." my opinion on the issue is that it may not be right but its what the people want and if people are fighting/debating of marrying people from the same gender then let them get what they want.

Taking the rights away of gay marriage violates the 14th amendment. I believe for them to even want to take away gay marriage is unfair. Judging and critisizing someone on what gender or sex they decide to date is cruel. This was very unconstitutional. the 14th amendment gurantees that no state can take away any citizend given rights that are given to them by the U.S. so therefore there should be no limit on love, gay rights, nor homosexuality.

The rights guaranteed in that Amendment are "or shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws". I feel that marriage has no limit it can be between anyone so I Think trying to basically tell people they can't be with who they love or that they are loving the wrong gender is not right. I fully support gay marriage.

It Went Against Gays Right. From The 14th Amendment it States The rights nor shall any state deprive any person of life,liberty or proverty without due process of law,meaning denying the rights of homosexual and their marriage is Unconstitional. The judges believed it was unconstitutional because it ostracised gays and limited their freedom. The constitution and laws were made to promote equal freedoms, not to deny them.
What amendment did they decide it violates?
Proposition 8 which claims that marriage can only be for one man and one women violates the 14th Amendment. The Proposition revokes a gay's, not several persons' right to marriage.
What right are you guaranteed in that particular amendment?
I am guaranteed a marriage with a another person. However some believe that the person who I'm allow to marry must be a male.
What is your opinion on the issue?
I believe love comes in all forms. America needs to act like other countries and legalize partnership/marriage for gays. Because homosexual deserve to have the privileges that come with marriage: such as if one of them dies the child (and savings) won't be taken by government because the other partner wasn't legally bound to their lover.

I think they should just legalize gay marriage in the U.S. altogether. One reason is because The gay community is increasing .Another reason is because this would violate the 1th amendment. If gay people aren't hurting the environment or society , I dont see why they wont legalize gay marriage.

Under that amendment it states nor shall any state deprive any person of life,liberty or proverty without due process of law and by saying gays can't get married is restricting those rights. Personally I believe that two people who truly love each other should get married and gender shouldn't matter.

I Do Agree That Outlawing Gay marriage Was Uncostitutional Because Gay People Should Be Treated Just Like Everyone Else And It Violated The 14th Amendment. people have the option to be gay or not that is part of their freedom but i think it is going to far by encourging it by allowing gay marriage like the homosexual rate2B should not be as high anyways but no since they keep allowing gay marriage more and more people are becoming gay which we were not made to be like that so i diagree with the government doing this

The judge decided it was unconstitutional because it limited gays rights. I think if family can get married two people of the same sex. its like saying their the same but not.

The judges decided it was unconstitutional because it unconstitutionally singles out gays and lesbians for discrimination.this proposition would put them in violation of the 14th Amendment, denying their right to civil marriage. I honestly feel that the judges did what they had to. Wether or not I'm glad it had to turn out that way is a different story.

Personally I dont think gay marriges should NOT be legal at any place at any time, im sorry if i offend anybody but i dont like gay males. God put us on this earth and he also put women on this earth, our gender is supposed to interact with the opposite gender.

In the 14th Amendment it says no state would be allowed to abridge the "privileges and immunities" of citizens. I think that if someone wants to be apart of the LGTB community then they should be allowed to because it's what they want and I think this breaks apart freedom of religion because people who find this "unconstitutional" is going off something the bible say and not everyone have religion/the same religion.

The judge would rule It unconstitutional because he don't believe in gay and lesbian marriage and that kind of mess up. The amendment that was violate was the 14th because it violate with the people equal protection clause. My opinion on this article is that gay marriage should not happen because it not right and kind of weird

The judges decided it was unconstitutional because it violates the 14th admendment, but you as a person have the right to talk to, marry, like, love etc. whoever you want. My opinion is that it really don't matter who you marry as long as someone is making you happy, thin you should be with that person no matter what is said.

It shouldn't matter if your gay straight, or even bisexual no one should be judge because of there sexual feelings towards someone everyone should be able to show affection to the person they love without being criticized everywhere they go and being judge because they have relations with the same sex but everyone is entitled to their own opinion but some people should just keep there mouth shut because they don't know when to stop and kind of take it to far if you dis like the same sex marriage then don't put yourself in a predicament where you would end up in a confrontation with them just keep to yourself

I myself don't care what people do with their love life if they want to be gay let them be they often say we live in a free country but with all these stupid laws it doesn't seem so free. I think many of the people who oppose gay people are those who go by the Bible but the Bible also says love everyone. I feel as though everyone who opposes it due to the Bible or what someone told them should do more research and those who just oppose it due to hatred should do something better with their life.

The Supreme Court judges ruled Proposition 8 unconstitutional because they say it violates citizens' rights to marry. They say the law also violates the 14th Amendment. Look here's the thing, when the 14th Amendment was written up it was not intended for same-sex marriage. It is for heterosexuals and has always been a heterosexual ritual. Gays know this because when they were growing they didn't even see spouses of the same sex. This amendment was for men and women and the gays know it. That's why spouse of the same sex are not recognized in over 40 states. Now true, it does bring revenue to a state. However, we should respect the decisions made by our former presidents and wholly and completely honor the law that has stood for over 140 years. VOTE NO TO GAY MARRIAGE!

Personally, I don't really care who other people date/marry. It's not my decision, so why should I care? The judges, decided that it was unconstitutional because, it violates citizens rights to marry. And to back up why they thought it was unconstitutional, they used the the 14th amendment. In the 14th amendment, you are guaranteed a marriage with another person. And again, I really don't care what happens because, it dosn't concern/involve me at all.

In that amendment, it says that if you are born in America, you are a legal resident citizen. My opinion on this issue is that they have the right to protest gay marriage because they're human! We all want to be happy and we should accept the fact that everyone is different.

It was unconstitutional because you can't discriminate against anybody which they were exactly doing to the gay and lesbian people. They violated the 14th amendment. That says that all persons born or naturalized shall enjoy full rights. I think they should legalize it because those people have the same rights as we do. They should be able to enjoy marriage just like everyone else can. I think it's unfair that they are being discriminated on. That's not fair to them.
